Abstract	The article is devoted to problem issues of damages caused by unlawful actions of bodies engaged in operational-search activities, pre-trial investigation and prosecution. Based on theoretical analysis and generalization of judicial practice explored the possibility of compensation for such damage in the event of failure of the prosecutor prosecutions. Made in Article findings may be used in the theoretical justification for amending legislation regulating the grounds and procedure for damages caused by unlawful actions of bodies engaged in operational-search activities, pre-trial investigation and prosecution.
